Terms of Service

1. Agreement to Terms
By accessing or using ServiceMonitor ("Service"), operated by Colab Technologies LLC ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
ServiceMonitor is a cloud infrastructure uptime monitoring platform. We provide automated health checks for cloud services (AWS, GCP, Azure, and others), uptime tracking, alerting via email, SMS, and Slack, public status pages, and a REST API for programmatic access.
3. Account Registration
To use the Service, you must create an account with a valid email address and password. You are responsible for maintaining the security of your account credentials. You must provide accurate information and keep it up to date. You must be at least 18 years old to use the Service.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to the Service or its systems
- Interfere with or disrupt the Service's infrastructure
- Use the Service to monitor endpoints you do not own or have authorization to monitor
- Resell or redistribute the Service without written permission
- Use the API in a way that exceeds reasonable rate limits
5. SMS and Messaging
If you opt in to SMS notifications, standard message and data rates may apply. You may opt out at any time by removing the SMS notification channel from your account settings or by replying STOP to any message. See our Messaging Policy for full details.
6. Billing and Payments
ServiceMonitor offers a free trial period. Paid plans are billed monthly or annually as selected. You may cancel at any time; cancellation takes effect at the end of the current billing period. We reserve the right to change pricing with 30 days' notice.
7. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. We are not liable for any damages resulting from service outages, delayed notifications, or inaccurate monitoring data. The Service is provided on an "as is" and "as available" basis.
8. Data and Privacy
Our collection and use of personal data is described in our Privacy Policy. By using the Service, you consent to the practices described therein.
9. Intellectual Property
The Service, including its design, code, logos, and documentation, is the property of Colab Technologies LLC. You retain ownership of any data you provide to the Service.
10. Account Termination
You may delete your account at any time from the Account Settings page. We may suspend or terminate accounts that violate these Terms. Upon termination, your data will be permanently deleted within 30 days.
11. Limitation of Liability
To the maximum extent permitted by law, Colab Technologies LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
12. Changes to Terms
We may update these Terms from time to time. We will notify registered users of material changes via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
